TERMS OF SERVICE
I. GENERAL TERMS
• I will not accept commissions that will turn the art piece into an NFT or NFT-related process/material under no circumstances. Turning the artwork into an NFT is not allowed, no matter if this is a private/individual/commercial commission.
• I draw in my style and my style alone. I will not copy anyone else’s style or attempt to make my work look similar to someone else’s. I expect my clients to have commissioned me because they like my work and style.
• Commissions are only accepted via google form.
• Commissions are NOT FIRST COME FIRST SERVES! I will accept the commissions I would like to do first.
• Provide clear, colored, detailed references. Please attach photos rather than links to a website, for sometimes they are not reliable. Characters with just descriptions or unclear references will be declined.
• I do not do design work for character reference sheets. I will only do design work for Full-Body commissions.
• Any ill or ugly behavior will not be tolerated and your commissions will be canceled without hesitation.II. PAYMENT
• Pricing is based on a number of factors, including (but not limited to): the overall complexity of your commission, the number of characters featured and how they are interacting, and how far I will be outside of my comfort zone (specific themes are a challenge for me and will cost a little more + take more time to complete).
• I require a nonrefundable deposit equal to 50% of the quoted price before I begin the sketch. If the total price of the commission is $100 or below, the full amount will be due before the initial sketch.
• Payment will be sent through a PayPal or Square invoice I will provide.
• If you are unable to make the full payment, we may discuss a payment plan or a partial payment.
• Once the sketch has been approved, the remainder can be paid at any time during the commission process but the balance must be paid in full before I can send you the high-res, unwatermarked images.
• As stated in the commission information form above, if you are wanting the commission done either on or before a certain date, I am obligated to add a rush fee. Where the rush fee can equal to half of the total cost of the commission, and up to doubled. We can discuss this further if you have any questions about the rush fee.
• Please note: If you would like a commission done before a specific date, make sure you place your order at least 2 months ahead of time. I will no longer accept commissions that need to be done in less than 4 weeks.III. PROGRESS / WORK FLOW
• Please note: I do NOT work on commissions in the order that I receive the forms.
• Work in progress photos will always be sent to the client with each step in the following order:Sketch⇒Lines⇒Flats⇒Final Render⇒Any additional Details• Please do not constantly ask if I have: worked on your commissions, or if it is done. If you would like to receive additional/multiple updates, please let me know ahead of time. I will try to keep you in the loop as much as possible during the process.
• Time for your commission to be completed can be from ONE (1) WEEK to up to SIX (6) MONTHS or longer depending on many factors, such as: physical/mental health, the order of the commissions, complexity, work, school, family issues, etc. If any of these occur, I will notify you immediately.IV. CUSTOMER SATISFACTION
• I will do everything I can to make my customers happy. During the Sketch phase, all changes will be free within reason.
• A few minor changes are allowed at no additional cost. Multiple minor changes or major changes will incur an additional charge. What is considered a minor or major change is up to me.
• If your reference was unclear to start with, then you are not allowed to do minor changes without a fee.
• I have the right to refuse any modification requests once a commission has been completed.
• Make sure to be clear in your order to what you aim for. I am not a mind reader, please do not assume as such. Communication is the key to satisfaction.
• No live adjustments. You're more than welcome to come into the stream while I work on your commission, however, I ask that you do not ask for modification mid-drawing. When I complete a sketch, I'll send it to you for any modification requests. If you're active in the chat, I will ask you if you would like any changes that are necessary, but you are not permitted to ask unless prompted in stream or via email.V. COPYRIGHT / COMMERCIAL RIGHTS / USAGE POLICY
• The client may use the commission piece FOR PERSONAL USE ONLY. Please tell me ahead of time if you would like to use your art for commercial purposes.
• The following is considered Copyright infringement: reproducing/using the copyrighted artwork commercially, taking credit for the creation of the artwork, removing any watermark and signature, altering the artwork without the artist's written consent, use for merchandise, etc.
• The only exception to this are Emote Commissions. Clients who order said emotes are allowed to use them for Twitch/YouTube for their intended monetization purposed.
• I am open and willing to discuss the commercial usage right purchase. Purchase of Commercial rights to the artwork will always be 200% of the original price. Please contact me for more details before sending a form.
• Credit is still required for usage of the artwork after purchasing the Commercial Rights, even if altered or edited.
• Please note that in some cases, I may require contracts for commercial works. This will be done at my discretion and I will always let you know before any work or payment is exchanged.
• I have the right to revoke commercial rights if I feel it has been compromised and/or have broken the agreement and contract.VI. CANCELING / REFUNDING POLICY
• I have the right to cancel and/or refund the payment for your commission at any time due to: poor communication, rude or inappropriate behavior, or the inability to communicate in a way we can both understand.
• If a refund does need to happen, I will refund depending on if I am in the sketch, line art, or coloring stage: a 75%, 50%, and 25% refund can be given respectively.
• Depending on the circumstances, the client may or may not receive the completed work, and may or may not retain any usage rights whatsoever.
• THERE ARE NO REFUNDS ON COMPLETED WORK. If you are unhappy with the final result, I do not accept refunds.
• If you file a chargeback against me, your right to everything listed here will be retracted.
• You will be banned to ever commission me, Crystal Daughtrey / Soma Shiokaze, ever again and will be publicly called out to warn others. If drastic measures have to happen, I have the right to file a complaint and the right to the payment you have sent me.If you have any other questions, feel free to drop me an email at [email protected]
